TRUSTEE’S NOTICE OF SALE

WHEREAS, by deed of trust dated February 27, 2014, Hayes Herron and wife, Vera Herron conveyed to Larry S. Banks, Trustee, certain real property located in Hardeman County, Tennessee, which deed of trust is of record in Trust Deed Book 717, Pages 690-693, Register’s Office, Hardeman County, Tennessee, for the purpose of securing the payment of the indebtedness therein set out and described, to which deed of trust reference is heremade for the particulars thereof; and
WHEREAS, the owner of said indebtedness, Arthur F. Smith Lumber Co., Inc., has declared default in the payment of same and has directed the undersigned, as trustee, to advertise and sell said property set out in said deed of trust in accordance with the terms thereof.
NOW, THEREFORE, by virtue of the authority vested in me by the said deed of trust as trustee, notice is hereby given that on Tuesday, February 24, 2015 at 10 a.m. at the West door of the courthouse in Bolivar, Tennessee, or as may be continued from time to time, I will sell to the highest and best bidder for cash, the following described real estate and improvements located thereon, lying and being in the _____ Civil District of Hardeman County, Tennessee, and more particularly described as follows, to-wit:
FIRST PARCEL:
Beginning at an iron stake in the west margin of Spring Hill Road, at the southeast corner of a 15.6 acre tract of land conveyed to Paul B. Keller, as shown of record in Deed Book D-4, Page 78, Register’s Office of Hardeman County, Tennessee; runs thence South 239 feet with the west margin of Spring Hill Road to a stake in same; thence continuing with said road South 29 degrees West 600 feet to a stake, a northeast corner of Paul Keller (now A. O. Sipes, Jr.); thence North 77 degrees West 212 feet to a stake; thence North 18 degrees East 219 feet to a stake; thence North 35 degrees East 540 feet to a stake, an internal corner of said 15.6 acre tract; thence North 86 degrees East 100 feet to the point of beginning.  Containing 4.02 acres, more or less.
INCLUDED IN THE FOREGOING DESCRIPTION BUT EXPRESSLY EXCLUDED FROM THIS CONVEYANCE is a lot off the north end of said tract fronting 192 feet on Spring Hill Road and running back South 86 degrees West 150 feet, leaving 3.2 acres, more or less, in the tract herein conveyed.
Being the same property conveyed to Hayes Herron by Quitclaim Deed recorded in Deed Book 31, Page 221 in the Register’s Office of Hardeman County, Tennessee.

SECOND PARCEL:
Beginning at a point in center of road, one pine pointer stands South 17-1/2 links; and runs thence North 62 degrees East 11 poles to a point in said road, one red oak pointer South 8 degrees East 23-1/2 links; thence North 40-1/2 degrees East 4 poles; thence North 28-1/2 degrees East 8 poles; thence North 56 degrees East 3 poles; thence North 74-1/2 degrees East 7/36 poles to a point in road on west boundary line of Lavern Jackson; thence with same South 19 poles to a stake, a southeast corner of Wilson Sain and 12 poles West of the old Red Oak corner tree; thence West 25.92 poles to the point of beginning, containing 1.48 acres without road, or 1.68 acres with road.
Being the same property conveyed to Hayes Herron by Warranty Deed recorded in Deed Book 46, Page 469 in the Register’s Office of Hardeman County, Tennessee.

Said property has an address of 540 Waller Lane.
THIRD PARCEL:
Beginning at a point where the Waller Road intersects the S. B. L. of Arthur Sain property and runs in a southwesterly direction 332 feet to a stake; thence North 240 feet to a stake; thence East 240 feet to a stake in Waller Road; thence in a south easterly direction with said road 82 feet to the point of beginning.
This being a portion of the land conveyed to Arthur Lee Sain and wife, Cinda Sain by Mandy Walker, et al, as shown of record in Deed Book M-10, Page 156, Register’s Office of Hardeman County, Tennessee.

Being the same property conveyed to Hayes T. Herron (being one and the same person as Hayes Herron) by deed recorded in Deed Book 0-10, Page 16, and corrected in Deed Book 0-10, Page 325 in the Register’s Office of Hardeman County, Tennessee.

Said property has an address of 660 Waller Lane
SAID SALE will be to the highest and best bidder for cash and free from the equity of redemption, dower, homestead, and such other exemptions which are specifically waived in said deed of trust; and the title to said property is believed to be good, but I will sell and convey as trustee only under the terms and authority of the deed of trust hereby foreclosed.
 SAID SALE may be adjourned to another time or may be postponed to another date by public announcement at the appointed time of sale without readvertisement.
SAID SALE shall be subject to unpaid property taxes, assessments, subdivision restrictions, building lines, easements and all prior liens and encumbrances of record superior in right to the deed of trust.
THERE WERE no recorded liens against Hayes Herron and wife, Vera Herron, by the United States of America with respect to which provisions of 26 U.S.C. §7425(b) require notice to be sent to the United States of America.
THERE WERE no recorded liens against Hayes Herron and wife, Vera Herron, by the State of Tennessee with respect to which provisions of Tennessee Code Annotated §67-1-1433(b)(1) require notice to be sent to the State of Tennessee.
There are no LIEN HOLDERS of record for which notice has to be given.
