SUBSTITUTE TRUSTEE SALE

Default having occurred in the payment of the debts and obligations by a certain Deed of Trust executed June 4, 2019 by Kelly G. Reed and Elizabeth V. Reed, husband and wife, to Charles J. Pignuolo, as Trustee, as same appears of record in the Office of the Register of Deeds of Hardeman County, Tennessee at Deed of Trust Book 765, Page 268, (the “Deed of Trust”) and the undersigned having been appointed Substitute Trustee by instrument recorded at Deed of Trust Book 809, Page 487, in the said Register’s Office; and the owner of the debt secured having requested the undersigned to advertise and sell the property described in and conveyed by said Deed of Trust, all of the said indebtedness having matured by default, at the option of the owner, this is to give notice that the undersigned will, on Friday, June 9, 2023, commencing at 11:00 a.m. at the main door of the Courthouse, Bolivar, Hardeman County, Tennessee, proceed to sell at public outcry to the highest and best bidder for cash, the following described property, to wit:

BEGINNING at an old iron rod in the southeast corner of the Wayne Bishop parcel; thence North 05 degrees 42 minutes 37 seconds East coincident with the east line of the Wayne Bishop parcel a distance of 310.60 feet to a point; thence South 88 degrees 58 minutes 55 seconds East coincident with the south line of parcel “A” a distance of 178.05 feet to a point; thence South 05 degrees 22 minutes 52 seconds West coincident with west line of parcel “A” a distance of 199.27 feet to a point; thence along a curve to the right having a radius of 316.67 feet and an arc length of 6.40 feet to a point; thence along a curve to the left having a radius of 324.92 feet and an arc length of 206.02 feet to a point; thence South 78 degrees 34 minutes 51 seconds West a distance of 10.36 feet to the point of beginning, containing 1.00 acres.

This being the same property conveyed to Kelly G. Reed and wife, Elizabeth V. Reed, by Warranty Deed, from Joe Kenneth McDonald and wife, Stephanie Frank McDonald, dated June 4, 2019, recorded June 5, 2019, of record in Deed Book 100, Page 8 in the Register’s Office for Hardeman County, Tennessee.

Together with all the improvements now or hereafter erected on the property, and all easements, appurtenances, and fixtures now or hereafter a part of the property.  All replacements and additions shall also be covered by this Security Instrument.  (The foregoing is hereinafter referred to as the “Real Property”.)

The Real Property bears the street address stated above; however, the street address is not a part of the legal description contained in the Deed of Trust.  In the event of a discrepancy between the street address and the legal description, the legal description of the Deed of Trust shall control.

All statutory right and equity of redemption, all right of homestead, dower and right of appraisement are waived in said Deed of Trust, and the title is believed to be good, but the undersigned will sell and convey only as Substitute Trustee.  Title is to be conveyed without any covenant or warranty, express or implied, and subject to all prior liens, easements, covenants, and restrictions that may exist, including, but not limited to, any unpaid ad valorem taxes or other taxes, and also subject to the right of redemption of the Internal Revenue Service or other taxing authority.  The notice required by 26 U.S.C. § 7425(b) to the United States has been timely given if applicable.  The notice required by T.C.A. § 67-1-1433(b)(1) to the State of Tennessee has been timely given if applicable.
